    1. ACCEPTANCE OF TERMS

    By accessing or using the FL Handyman LLC website, mobile application, job board, or any related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Platform.

    These Terms constitute a legally binding agreement between you ("User," "Client," or "Technician") and FL Handyman LLC ("Company," "we," "us," or "our"). By creating an account, booking a service, or otherwise engaging with our Platform, you acknowledge that you have read, understood, and agreed to these Terms.

    2. INDEPENDENT CONTRACTOR DISCLAIMER

    Critical Notice: FL Handyman LLC operates as a digital coordination and job-matching platform connecting property owners with independent service providers ("Technicians" or "Subcontractors").

    All Technicians utilizing our Platform are independent contractors, not employees, agents, or representatives of FL Handyman LLC. Each Technician is solely responsible for:

    • Obtaining and maintaining all required licenses, certifications, and permits under applicable law.
    • Carrying adequate liability and, if applicable, workers' compensation insurance.
    • The quality, safety, legality, and completion of their work.
    • Compliance with all building codes, OSHA safety requirements, and industry standards.
    • Any property damage, personal injury, or other liability arising from their work.
    • Reporting and paying all applicable taxes on earnings.

    FL Handyman LLC does not supervise, direct, or control the methods, tools, or means of work performed by any Technician. We are not liable for any acts, errors, omissions, representations, warranties, negligence, or damages caused by independent Technicians.

    3. CLIENT RESPONSIBILITIES

    Clients booking services through our Platform agree to:

    • Provide accurate and complete information regarding the property and project scope.
    • Ensure safe and legal site access for Technicians.
    • Secure pets, valuables, and personal belongings before work begins.
    • Communicate promptly with both FL Handyman LLC and assigned Technicians.
    • Approve completed work in a timely manner and make payment as agreed.
    • Report concerns or disputes promptly to FL Handyman LLC.

    Failure to comply may void any service protections offered through the Platform.

    4. TECHNICIAN RESPONSIBILITIES

    All Technicians utilizing the Platform agree to:

    • Maintain valid general liability insurance and required licensing.
    • Represent their qualifications truthfully.
    • Perform work to Florida Building Code and industry standards.
    • Use required PPE and follow OSHA guidelines.
    • Maintain professionalism and clear communication at all times.
    • Accept full responsibility for their workmanship, conduct, and any resulting damages.
    • Report any disputes, hazards, or scope changes immediately.

    Technicians acknowledge that they operate as independent businesses and are not entitled to employee benefits, insurance, or guarantees from FL Handyman LLC.

    5. PHOTO & MEDIA CONSENT

    By using our Platform, Users agree that FL Handyman LLC or its Technicians may take before-and-after photos or videos for documentation, training, and quality control purposes. These materials may also be used for marketing or portfolio showcases unless the Client provides written opt-out notice prior to work.

    Opt-out requests must be sent to contactus@usafloridahandyman.com before service begins. Photos used for quality control or dispute resolution cannot be excluded.

    6. CANCELLATIONS & DISPUTES

    Cancellations

    Clients may cancel a service up to 24 hours before the scheduled appointment without penalty. Cancellations with less than 24 hours' notice or no-shows may incur a fee up to 50% of the quoted price.

    Dispute Resolution

    FL Handyman LLC may assist in mediating disputes between Clients and Technicians but is not responsible for resolving them. All disputes must be reported within 48 hours of service completion and must include supporting documentation (photos, messages, receipts, etc.).

    As Technicians are independent contractors, any legal disputes between Clients and Technicians are the sole responsibility of those parties.

    7. PAYMENT TERMS

    All payments must be processed through FL Handyman LLC. Direct payments to Technicians outside of the Platform are strictly prohibited and may void any protections or warranties.

    Payment is due upon project completion and Client approval unless otherwise stated in writing. FL Handyman LLC reviews all completed jobs for quality assurance prior to disbursing Technician payouts.

    8. LIMITATION OF LIABILITY

    To the fullest extent permitted by Florida law:

    FL Handyman LLC, its officers, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or relating to:

    • The acts, omissions, or negligence of any independent Technician;
    • Property damage, personal injury, or economic loss caused by services performed;
    • Delays, cancellations, scheduling conflicts, or communication issues;
    • Use or inability to use the Platform; or
    • Any content, products, or services obtained through the Platform.

    FL Handyman LLC acts solely as a coordinating contractor and assumes no control over the means or methods of Technicians. Each Technician assumes full liability for their work and agrees to indemnify and hold harmless FL Handyman LLC against any claim, damage, or expense arising from their services.

    Our total liability, if any, shall not exceed the total amount paid to FL Handyman LLC for the specific project in question.

    9. GOVERNING LAW

    These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. All disputes shall be resolved exclusively in the courts of Palm Beach County, Florida.

    10. SMS MESSAGING TERMS

    By providing your phone number and enabling SMS notifications, you consent to receive text messages regarding:

    • Job opportunities or assignments,
    • Schedule updates, reminders, or confirmations,
    • Account notices or payment updates.

    Message frequency varies with activity. You may opt out anytime by replying "STOP" to a text or emailing contactus@usafloridahandyman.com.

    Standard message and data rates may apply.

    11. MODIFICATION OF TERMS

    FL Handyman LLC may update or amend these Terms at any time. Updates become effective immediately upon posting to our website, with the "Last Updated" date revised accordingly.

    Continued use of the Platform after any update constitutes acceptance of the new Terms. Users who disagree must discontinue use of the Platform.
